1. Acceptance of Terms

By creating an account, downloading the app, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the app. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.

2. Eligibility

To use our Services, you must:

• Be at least 13 years old (or the minimum age in your jurisdiction)
• If under 18, have parental or guardian consent
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Services under applicable law

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep control of the email account you sign in with (we use email sign-in links rather than passwords)
• Be responsible for all activity under your account
• Notify us immediately of any unauthorized access

4. Description of Services

ReadytoFly provides an educational wellness program designed to help users manage flight anxiety through:

• Guided daily audio sessions and self-guided preparation techniques
• A flight-day companion that accompanies you through the stages of a flight
• Educational content about aviation, flight safety, and cabin sounds
• Calming exercises designed to work offline, and before/after check-ins that track progress

5. Pricing and Payment

5.1 Subscription Plans

ReadytoFly Premium is an auto-renewing subscription: 3-day free trial, then $9.99/week or $79.99/year. Prices are in USD; the price shown at the moment of purchase in the App Store is the one that applies, and pricing outside the United States may differ by storefront. A free trial converts to a paid subscription unless canceled before the trial ends.

5.2 Payment Processing

Subscriptions are purchased inside the iOS app as in-app purchases processed by Apple and billed to your Apple ID. We never see or store your card details. By purchasing, you also agree to Apple's media services terms. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period; you can manage or cancel them at any time in your Apple ID subscription settings, and access continues until the end of the period already paid for.

Subscriptions bought on our website before August 12, 2026 were processed by Stripe, which still handles billing for those existing subscriptions. To manage or cancel one of those, contact us at admin@readytofly.app.

5.3 Refunds

For purchases made through the App Store, refunds are decided and issued by Apple, not by us: request one at reportaproblem.apple.com. We are not able to issue refunds for App Store purchases ourselves. For legacy website subscriptions billed by Stripe, contact us at admin@readytofly.app. Nothing in this section limits any non-waivable refund rights you have under the consumer law of your place of residence.

6. Medical Disclaimer

Our Services provide educational information and self-help tools. They do NOT:

• Provide medical diagnosis or treatment
• Replace professional therapy or counseling
• Treat anxiety disorders or other mental health conditions
• Provide emergency or crisis services

7. Acceptable Use

You agree NOT to:

• Use the Services for any unlawful purpose
• Share your account credentials with others
• Attempt to reverse engineer or hack the Services
• Copy, distribute, or modify our content without permission
• Use automated systems to access the Services
• Interfere with or disrupt the Services

8. Intellectual Property

All content, features, and functionality of the Services—including text, graphics, logos, audio, and software—are owned by ALERTAHORA LLC and protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

10. Disclaimers

We do not warrant that:

• The Services will meet your specific requirements
• The Services will be uninterrupted or error-free
• Any results from the Services will be accurate or reliable
• The Services will be effective for managing your flight anxiety

11. Limitation of Liability

Our total liability shall not exceed the greater of: (a) the amount you paid in the 12 months preceding the claim, or (b) $100 USD.

12. Indemnification

You agree to indemnify and hold harmless ALERTAHORA LLC, its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses arising from your use of the Services or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or engage in conduct that we determine is harmful to other users or our business.

Upon termination, your right to use the Services ceases immediately. Sections of these Terms that by their nature should survive termination will continue in effect.

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict of law principles.

14.2 Arbitration

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

15. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and ALERTAHORA LLC.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Our failure to enforce any right does not constitute a waiver of that right.
• Assignment: You may not assign these Terms. We may assign them to any affiliate or successor.
